AB 104 Summary

• For the 2021-22 academic year, school districts, county offices of education, and charter schools must implement a supplemental retention policy for pupils who received deficient grades (D, F, or No Pass) in at least half their coursework during 2020-21, excluding grade 12 students.

• Parents can request a retention consultation that must occur within 30 calendar days and include discussion of learning recovery options, research on retention effects, and the pupil's academic data and best interests.

• Pupils enrolled in high school during 2020-21 can apply to change letter grades earned that year to Pass or No Pass grades on their transcripts, with no negative impact on GPA or financial aid eligibility.

• California State University must accept Pass or No Pass transcripts for admission purposes; University of California and private institutions are encouraged to do the same.

• Pupils in their 3rd or 4th year of high school during 2020-21 who are not on track to graduate in four years are exempted from local graduation requirements beyond statewide coursework requirements and may complete requirements through a fifth year of instruction.
