AB 1242 Summary

• Prohibits California courts from issuing wiretap orders, pen register/trap and trace orders, or search warrants for evidence related to investigations into lawful abortions performed in California.

• Requires California corporations providing electronic communications services to refuse out-of-state legal process (warrants, subpoenas, court orders) related to investigations or enforcement of abortion-related crimes, unless accompanied by an attestation that the request does not involve a prohibited abortion violation.

• Prohibits state and local law enforcement from arresting anyone for performing, supporting, aiding, or obtaining a lawful abortion in California, and prevents public agencies from cooperating with or providing information to out-of-state or federal agencies about lawful California abortions.

• Requires courts to set bail at $0 for individuals arrested in connection with out-of-state proceedings regarding lawful abortions performed or obtained in California.

• Mandates that filing agencies electronically transmit copies of out-of-state arrest complaints and warrants to the Attorney General within 24 hours of filing.
