Food facilities must not provide single-use foodware accessories or standard condiments to consumers unless requested, effective for on-premises dining and third-party food delivery orders.

Single-use items (utensils, chopsticks, straws, stirrers, condiment cups/packets, splash sticks, cocktail sticks) and standard condiments (ketchup, mustard, soy sauce, salt, pepper, sugar, etc.) cannot be bundled in ways that force consumers to take unwanted items.

Drive-through consumers and walk-through consumers at public airports may be asked if they want single-use foodware accessories when necessary for food consumption or safe transport.

Food facilities using third-party delivery platforms must customize their menus to list available single-use items and only provide those selected by the consumer.

Cities, counties, and city-counties must authorize an enforcement agency by June 1, 2022; violations result in a notice for the first two infractions and fines of $25 per day (maximum $300 annually) for subsequent violations.

Exemptions apply to correctional institutions, health care facilities, residential care facilities, and public and private school cafeterias.
