AB 1300 Summary

• Authorizes residents or their representatives to install personal electronic monitoring devices (video cameras, audio devices) in their rooms at residential care facilities for the elderly, subject to roommate consent and notification requirements.

• Requires residents installing monitoring devices to post a conspicuous sign reading "This room is electronically monitored" at the room entrance and complete a notification and consent form that includes roommate approval.

• Permits facilities to use electronic monitoring devices without audio in entrances, exits, employee areas, lobbies, common areas, and outdoor spaces, but prohibits monitoring in restrooms or sleeping areas.

• Makes it a misdemeanor to knowingly damage, tamper with, or obstruct personal or facility monitoring devices; escalates to felony if done while committing or concealing a felony.

• Requires the State Department of Social Services to establish a program distributing up to $50,000 annually to Medi-Cal recipients for purchasing and installing monitoring devices, and to adopt implementing regulations by October 1, 2022.
