• Requires housing elements to include an assessment of fair housing that identifies segregation patterns, racially/ethnically concentrated areas of poverty, disparities in access to opportunity, and the local and regional historical origins and current policies contributing to fair housing issues.

• Requires the land inventory in housing elements to include an analysis of how identified sites relate to the jurisdiction's duty to affirmatively further fair housing and whether the inventory affirmatively furthers fair housing.

• Amends housing element requirements to assess contributing factors including historical origins and current policies that limit fair housing choice or access to opportunity.

• Contains operative provisions dependent on the status of Assembly Bill 1398, with reimbursement waived under Government Code Section 17556 as local agencies have authority to levy service charges to fund the mandated program.
