AB 141 Summary

• Establishes the Department of Cannabis Control within the Business, Consumer Services, and Housing Agency, consolidating cannabis regulation powers previously held by the Bureau of Cannabis Control, Department of Food and Agriculture, and State Department of Public Health.

• Extends provisional cannabis cultivation licenses until June 30, 2022 (and generally until January 1, 2026) with requirements for streambed alteration agreements and environmental compliance; prohibits issuance of new provisional cultivation licenses after January 1, 2022 that would exceed specified canopy size limits on contiguous premises.

• Authorizes the Governor to appoint a deputy director of equity and inclusion and requires the Governor's Office of Business and Economic Development to administer the California Cannabis Equity Act grant program to assist local equity applicants and licensees.

• Creates trade sample regulations allowing licensees to designate cannabis products for targeted advertising without payment or consideration, subject to testing and track-and-trace requirements; exempts trade samples from excise and cultivation taxes.

• Appropriates $10,000 from the General Fund to the Department of Cannabis Control for implementation and takes effect immediately as a budget-related bill.
