Establishes a public review process for critical care unit program flexibility requests effective January 1, 2023, including posting requests on the department's website and accepting public comment for 30 days.

Requires health facilities submitting critical care unit program flexibility requests to post the request form next to their license and immediately notify affected employees and representatives.

Limits critical care unit program flexibility approvals to one year maximum, with the department able to revoke approvals at any time if patient safety is jeopardized.

Requires the department to post on its website by February 1, 2023 a list of applicants and approved facilities, approval notifications with conditions, and a contact for public complaints regarding approved program flexibility.
