Exempts persons meeting income/benefit criteria from paying court fees and costs when petitioning to withdraw guilty pleas or set aside verdicts under Penal Code Sections 1203.4, 1203.41, 1203.42, and 1203.45.

Prohibits courts from denying record sealing or expungement relief to otherwise qualified persons solely because they have not satisfied victim restitution obligations.

Applies the fee waiver criteria already established in Government Code Section 68632, which includes persons receiving public benefits like SSI or Medi-Cal, or those with monthly income at or below 125% of poverty guidelines.

Prevents courts from denying relief based on unsatisfied restitution if the person meets the income/benefit eligibility standards for fee waivers.

Section 2 of the bill becomes inoperative if Senate Bill 1106 (2021-22 Regular Session) is enacted and becomes operative.
