Authorizes school district governing boards to appoint one or more nonvoting noncitizens as additional board members if they are parents or legal guardians of undocumented pupils enrolled in the district and reside within the district's boundaries.

Nonvoting noncitizen members may attend open board meetings and receive all materials, but cannot vote or be counted in determining votes required to carry any measure.

Nonvoting noncitizen members serve two-year terms starting June 1 of every other year, receive no compensation or mileage allowance, and are not liable for board actions.

Governing boards may discretionarily grant nonvoting noncitizen members additional privileges including making and seconding motions and attending certain closed sessions (excluding personnel and collective bargaining matters).

School districts adopting these provisions must adopt implementing rules and regulations by June 1 each year and are immune from money damages or retroactive relief if a court finds the section unlawful.
