Large group health care service plans and disability insurance policies must provide coverage for infertility diagnosis and treatment, including up to three completed oocyte retrievals with unlimited embryo transfers, effective January 1, 2023, with a lifetime maximum benefit of $75,000 per enrollee/insured.

Small group health care service plans and disability insurance policies must offer (but are not required to provide) coverage for infertility treatment, effective January 1, 2023.

Infertility is redefined to include conditions based on physician findings, inability to reproduce without medical intervention, or failure to establish pregnancy after 12 months of unprotected intercourse (6 months for persons age 35+).

Coverage cannot impose different conditions, limitations, or exclusions on fertility medications or infertility services compared to other medical conditions, and cannot exclude coverage based on use of donors, gestational carriers, or surrogates.

Religious employers as defined in existing law are exempt from these requirements; the bill does not apply to Medi-Cal managed care plans or entities contracting with the State Department of Health Care Services.
