AB 2097 Summary

• Prohibits public agencies from imposing minimum automobile parking requirements on residential, commercial, or other development projects located within 1/2 mile of public transit.

• Allows cities and counties to impose parking minimums if they make written findings within 30 days showing that eliminating requirements would substantially negatively impact their ability to meet regional housing needs or existing parking in the area.

• Exempts housing developments from the findings requirement if they dedicate 20% of units to very low/low/moderate-income households, students, elderly, or persons with disabilities; contain fewer than 20 units; or are subject to other parking reduction laws.

• Requires enforcement of electric vehicle charging and disabled-accessible parking requirements regardless of the minimum parking prohibition.

• Adds violations of these parking requirements to the list of housing law violations that trigger Department of Housing and Community Development notification and potential Attorney General enforcement actions.
