Pharmacists must provide patients with an opioid factsheet and information about lockable vial vendor assistance, and patients or their representatives may choose the vial code or request non-lockable vials.

Manufacturers must reimburse pharmacies within 30 days for lockable vial costs and dispensing services, with the State Board of Pharmacy establishing reasonable minimum and maximum reimbursement amounts by October 1, 2023.

Manufacturers failing to reimburse within 30 days face civil penalties of $1,000 per day, assessed by the board in civil court.

Prescribers and pharmacists are granted immunity from liability for vial failures or patient inability to access medication, except in cases of defective products, willful misconduct, recklessness, or gross negligence.
