Maintains existing requirements for licensees to obtain opt-in consent from persons before transmitting insurance records electronically, including disclosure of voluntary nature and ability to opt out.

Requires licensees to maintain systems demonstrating proof of delivery and actual receipt when transmitting records electronically that would normally require return receipt, registered mail, or certified mail delivery.

Mandates that licensees verify persons' email addresses via paper mail when more than 12 months have elapsed since last electronic communication.

Establishes enforcement procedures allowing the Insurance Commissioner to issue cease and desist orders for violations, with civil penalties up to $10,000 per violation (maximum $250,000 per investigation) or up to $250,000 for violations constituting general business practice.
