Local educational agencies may enter into memoranda of understanding with nonprofit eye examination providers to deliver noninvasive eye examinations and eyeglasses to pupils at schoolsites.

Eye examinations provided under this section must be supplemental to and not replace existing vision screenings required under Section 49455.

Schools must notify parents and guardians before eye examinations occur and provide an opt-out form; parents who previously filed written statements refusing physical examinations are automatically opted out unless they separately consent to the eye exam.

The State Department of Education must develop and post a model opt-out form by March 1, 2023.

Participating licensed health care professionals and local educational agencies have immunity from civil and criminal liability for providing authorized services without parental consent, except for gross negligence, willful misconduct, or crimes not authorized by this section.
