Removes the affirmative defense for unlicensed cannabis cultivation violations under Fish and Game Code Section 5650 (water pollution) in civil actions, while maintaining it for other defendants in criminal cases.

Authorizes county counsel to bring civil actions for water pollution violations resulting from unlicensed cannabis cultivation, in addition to the Attorney General, district attorney, or city attorney.

Allows county counsel to use fish and wildlife propagation fund money to investigate and prosecute civil actions for unlicensed cannabis cultivation water violations.

Authorizes city attorneys and county counsel to bring civil actions for unauthorized water diversion or use resulting from unlicensed cannabis cultivation under Water Code Section 1052, with 15-day notice requirement to the State Water Resources Control Board and regional boards.

Requires funds recovered from water trespass actions to first reimburse the Attorney General, city attorney, or county counsel for costs and attorney's fees before depositing remaining funds in the Water Rights Fund.
