Authorizes judges in superior court to offer misdemeanor diversion to defendants over the objection of a prosecuting attorney, with diversion periods not to exceed 24 months.

Requires judges to dismiss charges if defendants comply with imposed terms and conditions; allows reinstatement of criminal proceedings if defendants fail to comply.

Prohibits judges from offering diversion for sex offenses requiring registration under Section 290, spousal battery (Section 273.5), and stalking (Section 646.9).

Prohibits judges from offering diversion for various vehicle-related offenses including reckless operation of a vehicle (Section 23103 of Vehicle Code) and driving under the influence (Sections 23152 and 23153 of Vehicle Code).
