AB 32 Summary

• Authorizes FQHCs and RHCs to establish new patient relationships using audio-only synchronous interaction when the visit involves sensitive services as defined in Civil Code Section 56.05(n), or when the patient requests audio-only modality or attests they lack video access.

• Requires FQHCs, RHCs, and other Medi-Cal providers offering audio-only telehealth services to also offer video synchronous interaction by January 1, 2024, to preserve beneficiary choice, with exceptions possible based on technology access or broadband availability.

• Extends authorization for health care providers to establish new patient relationships using audio-only synchronous interaction under the same conditions as FQHCs and RHCs (sensitive services or patient request/lack of video access).

• Requires providers delivering telehealth to communicate to beneficiaries in writing or verbally about their right to in-person care, the voluntary nature of telehealth, availability of transportation coverage, and potential limitations compared to in-person visits.

• Applies effective January 1, 2023, or upon receipt of necessary federal approvals, whichever is later, and does not restrict existing telehealth service coverage prior to the operative date.
