AB 388 Summary

• Requires all certificated employees in school districts and county superintendent offices who complete 2 consecutive school years and are reelected to become permanent employees, regardless of average daily attendance.

• Expands the definition of a complete school year for probationary employees to include those working less than full-time (75% of assigned days) and adult education program employees (75% of full-time equivalent hours).

• Allows service as an instructor in regional occupational centers or programs to count toward permanent employee classification by repealing the prior prohibition.

• Applies uniform dismissal procedures for first and second-year probationary employees across all school districts, eliminating separate procedures for districts with fewer than 250 pupils in average daily attendance.

• Exempts provisions from application to collective bargaining agreements entered before January 1, 2022, until those agreements expire or are renewed.
