State Department of Education must develop guidance by July 1, 2023, for schools participating in the federal School Breakfast Program on serving breakfast or morning snacks to non-enrolled children who are siblings or foster children of eligible pupils.

Guidance must highlight opportunities to maximize federal reimbursement through the federal School Breakfast Program and federal Child and Adult Care Food Program.

A guardian must be present at the school site for a non-enrolled child to receive breakfast or a morning snack.

Defines "eligible nonschoolaged child" as a child not enrolled in school who is a sibling, half-sibling, stepsibling, or foster child of a pupil eligible for free or reduced-price breakfast.

Implementation is optional for local educational agencies; the state is not required to mail the guidance to schools.
