Prohibits the department from requiring applicants to disclose criminal history information when securing electronic fingerprints, except to inquire about out-of-state sex offense convictions requiring registration under the Sex Offender Registration Act.

Applies to criminal background check requirements for residential care facilities, childcare facilities, and home health agencies, establishing consistent procedures across multiple facility types.

The working group and reporting provisions automatically repeal on January 1, 2025.
