• Extends hazardous substance and air emissions protections for schoolsite acquisition and construction to charter schools and private schools, previously applying only to school districts.

• Requires charter schools and private schools to determine that proposed schoolsites are not located on hazardous waste disposal sites, hazardous substance release sites, or sites containing pipelines carrying hazardous materials.

• Mandates charter schools and private schools notify and consult with local administering agencies and air pollution control districts to identify facilities within 1/4 mile of proposed schoolsites that emit hazardous air emissions or handle hazardous substances.

• Requires the State Department of Education to advise charter schools on schoolsite acquisition upon request, consistent with existing requirements for school districts.

• Creates a state-mandated local program requiring cities and counties to make determinations and findings regarding hazardous conditions and emissions for charter school and private school projects.
