Export of mixed plastic wastes out of the country is classified as "disposal" rather than recycling diversion, unless the mixture contains only polyethylene, polypropylene, or polyethylene terephthalate destined for separate recycling and complies with destination country laws.

Exemption from export restrictions applies to Canada and Mexico until January 1, 2024, or expiration of applicable trade agreements, whichever is later.

Recycling and composting facilities must report the jurisdiction or region of origin for exported mixed plastic wastes, with exceptions for plastic waste consisting only of resin types 1, 2, or 5.

The Department of Resources Recycling and Recovery must make publicly available information on the jurisdiction or region of origin and tonnage for exported mixed plastic wastes.

Civil penalties of $500 to $5,000 apply for failure to submit required information, and $500 to $10,000 for knowingly filing false reports or obstructing department inspections.
