CA SB1071

Authorizes attorneys participating in administrative hearings regarding Aid to Families with Dependent Children-Foster Care, kinship programs, adoption assistance, and resource family approvals to inspect and receive copies of a minor's juvenile case file, with restrictions on use and sealing requirements after the hearing concludes.

Requires agencies to attach portions of the juvenile case file used in making their decision to their position statements in specified administrative hearings, with confidentiality protections and a requirement that the State Department of Social Services establish a fair document exchange process.

Requires case records and relevant nonprivileged information to be available for inspection by applicants or recipients no later than 5 working days prior to the hearing when regulations require agencies to allow such examination.

Mandates the State Department of Social Services to implement procedures through all-county letter by January 1, 2024, and adopt formal regulations by that date to classify pertinent juvenile case file sections and establish fair document exchange processes between agencies and attorney representatives.

Incorporates provisions from Assembly Bill 2711 if both bills are enacted, with Section 1.5 becoming operative only if SB 1071 is enacted after AB 2711.
