Adds Section 52.8 to the Civil Code, requiring prevailing plaintiffs to be awarded attorney's fees and costs in civil actions against any person or entity that distributes, benefits from, promotes, or induces distribution of unauthorized obscene materials, including electronic distribution.

Defines "obscene material" as material that appeals to prurient interest, depicts or describes sexual conduct in a patently offensive way, and lacks serious literary, artistic, political, or scientific value when applied to contemporary statewide standards.

Defines "unauthorized" to include obscene material that was coerced, made, obtained by trickery or subterfuge, stolen, or distributed without knowledge or express permission of the person depicted, or any obscene material depicting someone under 18 years of age.
