CA SB1265

Authorizes a person protected by a restraining order who shares court-authorized in-person custody or visitation with children to file an ex parte request to modify the custody or visitation order if the restrained person has been arrested for or charged with a crime involving assaultive conduct or use of a weapon within the preceding 45 days.

Requires the court to hear the ex parte request on the same day it was filed before 10 a.m., or the next day if filed after 10 a.m., and permits remote appearance by the person seeking the order.

Authorizes the court to suspend the restrained person's in-person contact with children until a noticed hearing is conducted within 15 days.

Requires the court to conduct a criminal background search prior to the noticed hearing and provide results to both parties before the hearing.

Eliminates filing fees for any motions or documents filed related to the ex parte request and modification of custody or visitation orders.
