Lake Arrowhead Community Services District may enforce all or part of covenants, conditions, and restrictions for tracts and assume duties of the Arrowhead Woods Architectural Committee, subject to specific procedural requirements.

District must receive a written request from the Arrowhead Woods Architectural Committee board and petition signed by a majority of affected property owners before enforcing covenants and restrictions.

District must conduct a public hearing, submit an application to the local agency formation commission, and receive commission approval before assuming enforcement powers.

Property owners within affected tracts must finance enforcement through fees, regular or special assessments that may be enforced by either the Arrowhead Woods Architectural Committee or the district under Section 61122 procedures.

Arrowhead Woods Architectural Committee must indemnify the district for litigation costs, settlements, injuries, damages, or judgments arising from enforcement activities, and district cannot enforce covenants until unlawfully restrictive covenants are removed pursuant to Section 12956.2.
