Repeals requirement that non-killer accomplices in felony murder be sentenced to death or life without parole if they were a major participant and acted with reckless indifference to human life.

Restores judicial discretion to strike or dismiss special circumstances in murder cases, overturning restrictions imposed by Proposition 115 (1990).

Limits accomplice liability for felony murder special circumstances to those who acted with intent to kill, with specific exceptions for peace officer murders and other enumerated circumstances.

Maintains enhanced penalties for actual killers and accomplices who personally used weapons or acted with intent to kill, including mandatory life without parole for peace officer murders.

Takes effect immediately as an urgency statute.
