Department of Toxic Substances Control must revise its Violations Scoring Procedure regulations by July 1, 2022, for consistency with new calculation requirements effective January 1, 2023.

Changes the Facility VSP Score calculation by removing the division by number of inspections; instead, scores are calculated by summing provisional and final inspection violation scores from the preceding 10-year period without averaging.

Revises compliance tier thresholds: Acceptable (VSP Score below 100), Conditionally Acceptable (VSP Score 100-249), and Unacceptable (VSP Score 250 or greater).

Applies new scoring methodology to hazardous waste facilities beginning with the 2022 calendar year and annually thereafter.

Addresses concern that dividing violation scores by inspection count dilutes scores for facilities with more inspections, obscuring the true magnitude of harm caused by non-compliant facilities.
