Beginning July 1, 2023, awarding authorities must require successful bidders on eligible projects to submit a report within 90 days of project completion that includes the amount of concrete used and an Environmental Product Declaration (EPD) current at time of installation for each concrete product.

Concrete suppliers must provide EPDs for each concrete product supplied to successful bidders on eligible projects.

Beginning January 1, 2025, the Department of General Services must establish and publish GWP (global warming potential) benchmarks for each concrete performance class by region based on regional industry average GWP, updating at least every 3 years.

Beginning January 1, 2025, awarding authorities must require that total project concrete CO2e does not exceed a project-specific limit calculated using the established GWP benchmarks, and successful bidders must submit analysis demonstrating compliance with this limit.

Concrete suppliers are liable for indemnifying successful bidders for penalties resulting from supplying invalid EPDs or concrete products exceeding CO2e limits, unless the bidder failed to provide specifications or adequate time to modify proposals due to material specification changes.
