CA SB82

Divides theft into three degrees: grand theft, petty theft in the first degree, and petty theft in the second degree.

Defines petty theft in the first degree as taking property from a person or commercial establishment by force or fear without a deadly weapon or great bodily injury, excluding organized retail theft schemes.

Establishes petty theft in the first degree as punishable by up to one year in county jail and/or a $1,000 fine; petty theft in the second degree as punishable by up to six months in county jail and/or a $1,000 fine.

Prohibits petty theft in the first degree from being charged as robbery or burglary.

Creates mechanism for currently incarcerated persons convicted of robbery without deadly weapons or great bodily injury to petition for conviction vacation and resentencing effective January 1, 2022.
