CA AB1008

Specifies that personal information can exist in various formats, including physical formats (paper documents, printed images, vinyl records, video tapes), digital formats (text, image, audio, video files), and abstract digital formats (compressed or encrypted files, metadata, artificial intelligence systems).

Adds "neural data" as a category of sensitive personal information, defined as information generated by measuring activity of a consumer's central or peripheral nervous system that is not inferred from non-neural information.

Incorporates amendments to Section 1798.140 of the Civil Code proposed by both AB 1008 and SB 1223, with Section 1.5 becoming operative only if both bills are enacted and AB 1008 is enacted after SB 1223.

Declares that the bill furthers the purposes and intent of the California Privacy Rights Act of 2020, allowing the Legislature to amend the act by majority vote of both houses.
