School districts, county offices of education, and charter schools may provide emergency stock albuterol inhalers to school nurses or trained volunteers to administer to persons experiencing respiratory distress.

The Superintendent of Public Instruction must establish minimum training standards for administering stock albuterol inhalers and review these standards every 5 years, consulting with relevant medical and educational organizations.

Training must cover recognizing respiratory distress symptoms, storage and emergency use procedures, emergency follow-up protocols, and CPR recommendations, provided to volunteers during work hours at no cost.

Local educational agencies utilizing stock albuterol inhalers are protected from civil liability for emergency administration except in cases of gross negligence or willful misconduct, and must provide legal defense and indemnification to volunteer employees.

Schools must obtain prescriptions for stock albuterol inhalers from an authorizing physician, maintain them until expiration, and restock within two weeks after use.
