Expands the definition of water trespass to include any unauthorized diversion or use of water, removing the previous limitation to water "subject to this division."

Authorizes the State Water Resources Control Board to issue curtailment orders for any water diversion when water is not available under the diverter's priority of right, regardless of the basis of the water right.

Requires the board to adopt regulations implementing curtailment authority, changing previous discretionary language to mandatory.

Adds failure to comply with a curtailment order as a form of trespass under existing civil liability provisions.

Authorizes the board to issue cease and desist orders against water right holders who fail to curtail diversions when water is unavailable under their priority of right.
