County agricultural commissioners may levy civil penalties of up to $3,000 per violation for pesticide regulation violations, in lieu of civil prosecution by the director.

Class A violations for pesticide drift in school areas are subject to fines of up to $15,000 per violation, and violators must pay a monitoring fee of up to $50 for each subsequent pesticide application in school areas for 24 months.

Before levying penalties, the county agricultural commissioner must provide written notice and allow the violator a hearing within 20 days to present evidence.

Violators may appeal the county agricultural commissioner's decision to the director within 30 days, and the director may affirm, modify, or reverse the penalty decision.

After exhausting appeals, final penalty decisions may be filed with the superior court for immediate judgment entry without clerk fees.
