Establishes separate penalty structure for firms, corporations, businesses, retailers, or wholesalers that sell tobacco or related products to persons under 21 years of age: $500 for first offense, $1,000 for second offense, and $5,000 for any subsequent offense.

Maintains existing penalties for individual persons: $200 for first offense, $500 for second offense, and $1,000 for third offense.

Exempts active duty military personnel 18 years of age or older from the prohibition when presenting valid U.S. Armed Forces identification.

Provides a defense if the seller demanded, was shown, and reasonably relied upon government-issued identification proving age of majority.

Allocates 25 percent of collected civil and criminal penalties to the city attorney, county counsel, or district attorney responsible for the successful enforcement action.
