Amends Penal Code Section 987.9 to allow any prosecuting agency representing the state to access confidential defense funding records during appeals or collateral review, replacing the prior limitation to only the Attorney General.

Modifies Penal Code Section 1405 to require that DNA testing laboratories be mutually agreed upon by the district attorney or Attorney General and the convicted person filing the motion, regardless of whether the case is capital or noncapital.

Maintains all other requirements for postconviction DNA testing motions, including the need to establish evidence availability, chain of custody, materiality to identity, and use of scientifically accepted methods.
