Creates the California Agave Commission to promote the agave industry, with a board consisting of 6 growers, 2 processors, and 1 public member appointed by the Secretary of Food and Agriculture.

Commission becomes operational only after a referendum vote where at least 40% of growers and processors participate, with either 65% voting in favor and controlling a majority of production volume, or a simple majority controlling 65% of production volume.

Authorizes the commission to levy annual assessments on growers and processors not to exceed $1,000 for smaller operations and $50,000 for larger operations, with funds used for research, education, marketing, and promotion of agave products.

Grants the commission authority to conduct civil actions for unpaid assessments and civil penalties up to $1,000 for false reports, failure to report, record destruction, or refusal to provide grower information.

Commission operation can be suspended or terminated every five years through a public hearing and referendum process, with funds returned pro rata to assessed parties if operations conclude.
