Incarcerated persons in state prisons are allowed relief from prison employment after the death of an immediate family member, as defined in Title 15 of the California Code of Regulations.

Relief from employment is also extended to incarcerated persons enrolled in educational programs and is limited to a maximum of three days per occurrence.

Incarcerated persons must receive their regular compensation for hours scheduled to work during the relief period and have access to mental health professionals during this time if resources are available.

Relief may be denied only if the incarcerated person works in an emergency response position (such as firefighter) and an exigent circumstance requires their employment; such relief must be granted as soon as practicable after the emergency ends.

Wardens and prison administrators are prohibited from disciplining, punishing, or discriminating against incarcerated persons for requesting or exercising bereavement relief.
