Property owners selling agricultural land in areas of cultural and traditionally significant land must notify affiliated California Native American tribes of a first right of refusal before selling or negotiating with third-party buyers.

California Native American tribes have 30 days after receiving notice to express written interest in purchasing the agricultural land.

If a tribe expresses interest, the property owner and tribe must enter into good faith negotiations for at least 90 days to determine mutually satisfactory sale terms (excluding price).

Sale price must be the appraised fair market value unless all parties agree otherwise; the property may be sold without regard to these provisions if the tribe does not express interest within 30 days or if non-price terms cannot be agreed upon after 90 days.

Any California Native American tribe that purchases agricultural land under this article must continue using it for agricultural purposes.
