Licensed family daycare homes in buildings constructed before January 1, 2010 must serve only filtered water to children and use filtered water in food preparation, effective January 1, 2027, using point-of-use filtration devices certified to NSF/ANSI standards for lead and particulate reduction.

Department of Social Services must adopt regulations by January 1, 2026 specifying filtration standards, installation and maintenance requirements, record-keeping procedures, and enforcement actions including violation letters and temporary license suspension for non-compliance.

Family daycare homes with lead levels above 5 parts per billion must immediately switch to alternative potable water sources (including bottled water) until filters are replaced, and must notify parents within 5 business days of test results.

Family daycare homes can be exempted if they provide two rounds of test results showing lead levels did not exceed 1 part per billion within the prior year.

Department must submit a report to the Legislature by July 1, 2029 on compliance rates, violations, license suspensions, and lead test results; federal EPA grant funds may be used to provide filters to family daycare homes, prioritizing providers serving low-income children.
