Exempts general acute care hospitals from tissue bank licensing requirements when storing or distributing pasteurized donor human milk obtained from a state-licensed tissue bank, but requires tissue bank licensure for hospitals collecting, processing, storing, or distributing human milk in any other circumstance.

Requires hospitals exempt from tissue bank licensure to comply with standards established by the Human Milk Banking Association of North America or other department-approved standards.

Designates medically necessary pasteurized donor human milk from a licensed tissue bank as a basic health care service that must be provided by health care service plans and health insurers.

Eliminates screening test requirements for human milk collected from a mother exclusively for her own child.

Specifies no state reimbursement is required because costs are associated with changes to criminal penalties under existing law.
