Prohibits employers and their agents from prohibiting or implementing policies that prevent restaurant employees from receiving gratuities paid, given to, or left by patrons.

Violation of the prohibition is a crime under California law.

Builds upon existing gratuity protections in California law that already prohibit employers from taking gratuities or crediting them against wages.

States that no state reimbursement is required for local agencies or school districts since costs result from creation of a new crime.
