School districts, county offices of education, and charter schools must develop and adopt a policy by July 1, 2026 to limit or prohibit student smartphone use on school sites or under school supervision, with updates required every 5 years.

Policies must promote evidence-based smartphone practices to support student learning and well-being, involve significant stakeholder participation, and may include enforcement mechanisms to limit smartphone access.

Students cannot be prohibited from possessing or using smartphones in emergencies, when a teacher or administrator grants permission, when medically necessary as determined by a licensed physician, or when required by an individualized education program.

The state shall reimburse local agencies and school districts for any costs mandated by this act if determined by the Commission on State Mandates, pursuant to Government Code Part 7.

Schools are prohibited from monitoring, collecting, or accessing information related to a student's online activities under this policy.
