Director of Social Services must develop procedures for general and migrant childcare and development contractors to identify and report data on dual language learners using a family language instrument and family language and interest interview.

Procedures must align to the maximum extent practicable with the existing procedures required for state preschool contractors under Education Code Section 8241.5.

Reported data must include the child's home language, race or ethnicity, language characteristics of the program, and language composition of program staff, submitted on a timeframe determined by the director.

Parents or guardians cannot be compelled to complete the family language instrument or participate in the interview, and declining to do so cannot affect a contractor's contract or a child's eligibility to enroll.

The Director of Social Services and Superintendent of Public Instruction must coordinate implementation efforts, and the director must develop informal directives by August 16, 2024, pending formal regulatory adoption.
