Amends Health and Safety Code Section 25250.1 to modify exemption criteria for used oil from hazardous waste regulation by the Department of Toxic Substances Control.

Provides an alternative exemption pathway for used oil that is not subject to federal hazardous waste regulation and meets specified state testing criteria, rather than requiring compliance with all federal regulations.

Maintains existing exemption requirements including purity standards (limits on lead, arsenic, chromium, cadmium, halogens, and PCBs) and prohibitions on mixing with listed hazardous wastes.

Requires generators claiming used oil exemptions to notify the department in writing and comply with testing and recordkeeping requirements under Section 25250.19 before reuse.

Places burden of proof on generators, recycling facilities, transporters, or users to demonstrate that used oil meets applicable standards and exemption criteria in any enforcement action.
