Eliminates the January 1, 2025 repeal date for existing provisions requiring the Department of Transportation to provide guidance and compensation for worker safety devices on state highways, making these provisions permanent.

Requires the Department of Transportation to prescribe standards and specifications mandating appropriate use of positive protection measures (such as automated flagger assistance devices, buffer lanes, and impact attenuator vehicles) on all covered activities on the state highway system after submitting a required January 1, 2024 report to the Legislature.

Limits department compensation for optional safety devices to those requested on the department's own public works projects, rather than all public works projects.

Requires contractors who receive compensation for optional safety devices to use them in conformance with department guidance, with the Division of Occupational Safety and Health authorized to enforce this requirement through regulations.

Authorizes the Department of Transportation to adopt regulations necessary to implement these provisions without compliance with the Administrative Procedures Act.
