AB 764 Summary

• Establishes uniform statewide redistricting requirements for counties, cities, school districts, community college districts, and special districts whose governing bodies are elected by districts, effective January 1, 2024.

• Requires local jurisdictions to hold at least one workshop and 5 public hearings before adopting new district boundaries, with provisions for evening/weekend hearings, remote participation, and live translation in applicable languages.

• Mandates adoption of district boundaries no later than 204 days before the next regular election occurring after January 1 in years ending in 2, with court enforcement available if deadlines are missed.

• Sets redistricting criteria in order of priority: population equality, compliance with federal Voting Rights Act, geographic contiguity, respect for neighborhoods and communities of interest, and geographic compactness, while prohibiting incumbent protection gerrymandering.

• Requires local jurisdictions to establish dedicated redistricting web pages, maintain accessible redistricting records, publish draft maps and public comments online, and adopt public education and outreach plans.
