Changes enforcement of California's flavored tobacco product ban from infraction penalties to civil penalties aligned with the STAKE Act (Stop Tobacco Access to Kids Enforcement Act)

Establishes civil penalty schedule for violations of the flavored tobacco ban, with suspension or revocation of tobacco retailer licenses upon the third, fourth, or fifth violation

Authorizes the State Department of Public Health as primary enforcement agency, with authority for other state and local agencies to also conduct inspections and assess penalties

Maintains existing exceptions allowing flavored shisha tobacco products at licensed hookah retailers that exclude minors and comply with all state and local laws

Directs $250 additional civil penalties assessed for third through fifth violations to be deposited in the Cigarette and Tobacco Products Compliance Fund for the Department of Tax and Fee Administration
