Police departments and sheriff's offices must use the name and pronouns provided by arrested individuals when posting booking photos on social media, with limited exceptions for locating fugitives or addressing imminent threats.

Booking photos must be removed from social media within 14 days unless circumstances exist involving fugitives, imminent threats, court orders, or exigent circumstances.

Police departments and sheriff's offices may include other legal names or known aliases only when necessary to locate or apprehend an individual, eliminate an imminent threat, or in exigent circumstances involving urgent law enforcement interests.

Existing restrictions on sharing booking photos of individuals arrested for nonviolent crimes remain in place, with exceptions for fugitives, imminent threats, judicial orders, and exigent circumstances.

The 14-day removal requirement and pronoun usage requirement apply retroactively to all booking photos previously shared on social media.
