Amends California Constitution Section 31 to prohibit the state from "harmfully" discriminating against or granting preferential treatment based on race, sex, color, ethnicity, or national origin in public employment and education (removes public contracting from the prohibition).

Allows state and local agencies to fund research-based or research-informed culturally specific programs if they eliminate legal barriers to equality and equitable outcomes, empower individuals to live longer and healthier lives, and do not utilize harmful discriminatory practices.

Exempts public contracting and higher education student admission or enrollment from the provisions, and excludes moneys spent by University of California, California State University, and community college districts.

Removes the Governor's approval requirement that was in earlier versions and clarifies that state moneys used for programs must be properly appropriated.

Defines key terms including "culturally specific program," "research-based program," "research-informed program," "state agency," "local agency," and "disaggregated data" for implementation purposes.
